Elevate DJs - Terms of Service
These Terms and Conditions of Service (“Terms”) apply to all bookings with Elevate DJs (ABN: 49 802 127 185). By engaging our services, making a booking, or paying a deposit, you (“the Client”) agree to be legally bound by these Terms. These Terms form a binding agreement between Elevate DJs (“the Supplier”) and the Client.
If you do not agree to these Terms, you must not proceed with a booking.
1. Definitions

Client: The individual or organisation hiring Elevate DJs.

Event: The function, party, wedding, or occasion booked.

Services: DJ, sound, lighting, and related entertainment services supplied by Elevate DJs.

Deposit: The non-refundable booking fee paid to secure services.

Balance: The remainder of the agreed total fee, payable prior to the Event.
2. Payment Terms
2.1 Deposit: A non-refundable deposit, specified at the time of booking, is required within 7 days. Until the deposit is received, the booking is not confirmed and the date remains open to other clients.
2.2 Balance: The Balance must be paid in full by the due date shown on the invoice (generally 2 - 4 weeks before the Event). Failure to make payment by the due date entitles Elevate DJs to cancel the booking and retain the Deposit.
2.3 Payment Methods: Payment may be made by Direct Bank Transfer (no surcharge). Cash payments on the night are accepted only if expressly pre-approved in writing.
2.4 Non-Payment on Event Night: If payment has not been made prior to the scheduled start time of the Event, the DJ will not commence and may leave the venue. In this case, the Client remains liable for the full fee.
3. Cancellations & Refunds
3.1 30+ days before Event: Deposit is forfeited.
3.2 7–14 days before Event: 50% of total booking fee is payable.
3.3 Less than 7 days before Event: 100% of total booking fee is payable.
3.4 Refunds: Refunds are only provided in accordance with Australian Consumer Law.
3.5 Date Changes:

One change is permitted without charge if requested with 60+ days’ notice and subject to availability.

Subsequent changes or changes to location, time, or Event type may require a re-quote.
4. Supplier Obligations
Elevate DJs agrees to:
a) Provide Services as described in the booking confirmation and invoice.
b) Arrive with sufficient time to set up and commence at the agreed start time.
c) Maintain professional presentation and ensure all equipment is in good working order.
d) If the assigned DJ is unable to attend due to unforeseen circumstances, provide a suitable replacement at no extra cost. If no replacement is available, Elevate DJs will issue a full refund.
5. Event Shutdowns & Early Finishes
If the Event is terminated, closed, or shut down prior to the scheduled finishing time (including but not limited to: venue management, security, police intervention, fire, noise complaints, safety concerns, or Client decision), the Client remains liable for the full agreed booking fee. No refunds, partial payments, or discounts will apply.
6. Venue & Setup Requirements
6.1 Power & Shelter: The Client must ensure that adequate power outlets and shelter (if outdoors) are available. Failure to provide these may prevent performance, and Elevate DJs accepts no liability for non-performance in these circumstances.
6.2 Space & Equipment: Standard setup includes one DJ booth, two speakers (plus subs if booked), and lighting in a single location. Multiple setups or additional coverage must be requested at the time of booking and may incur extra costs.
7. Food & Breaks
For bookings of five (5) hours or more, the Client must provide a meal for the DJ or permit a reasonable meal break. If a meal is not provided, Elevate DJs reserves the right to obtain one at the Client’s expense.
8. Guest Behaviour & Safety
8.1 The Client is responsible for the behaviour of all guests at the Event.
8.2 The DJ reserves the right to cease performance or leave the venue if:

Guests are abusive, threatening, or violent.

Equipment is damaged, tampered with, or at risk.

The DJ’s personal safety is compromised.
8.3 Any damage to equipment caused by the Client, guests, or venue is the Client’s responsibility, and repair or replacement costs (up to retail value) will be charged.
9. Force Majeure
Elevate DJs is not liable for failure to perform due to events beyond its reasonable control, including but not limited to natural disasters, extreme weather, accidents, power failure, illness, or government restrictions.
10. Media & Promotion
Unless otherwise agreed in writing, the Client grants Elevate DJs permission to capture and use photography, audio, or video footage from the Event for promotional purposes (e.g., social media, website). The Client may withdraw this consent in writing at any time.
11. Privacy
Elevate DJs will only collect, use, and store personal information as necessary to provide Services and comply with legal obligations. Personal information will not be disclosed to third parties without consent, except as required by law.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
13. Entire Agreement
These Terms, together with the booking confirmation and invoice, constitute the entire agreement between Elevate DJs and the Client. No verbal agreements or representations shall override these Terms.
